1. Definitions

"Service" means the Redtail digital provenance platform, including the website, record creation flow, record hosting, and all related features operated by the Operator.

"Record" (or "provenance record") means a digital record created through the Service, containing information provided by the User (uploads, title, description, attributes) and, where applicable, an on-chain transaction reference.

"User" means any individual or entity using the Service, whether as a guest or with an account.

"Consumer" means a natural person who uses the Service for purposes outside their trade, business, craft, or profession, as defined under applicable consumer protection law.

"Business User" means a User who uses the Service in the course of their trade, business, craft, or profession.

"Charge" means the amount due for a Record created through the Service, as described in the Billing & Payment section below.

"Content" means any files, images, PDFs, text, descriptions, and attributes uploaded or entered by a User.

"Full Performance" means the point at which the Service is considered fully performed, as defined in the Right of Withdrawal section below.

2. Purpose of the Service

Redtail – Digital Provenance Platform allows Users to create and share digital provenance records for items and documents (for example: a photo or PDF, plus a title, description, and attributes).

Records are digital provenance logs. Each Record may include a transaction hash (tx hash) anchored on the Base blockchain. A "Success" status on BaseScan confirms the transaction was executed on-chain — it does not authenticate the physical item, nor does it prove ownership, value, or regulatory compliance. On-chain entries are immutable and cannot be deleted.

BaseScan is a third-party blockchain explorer. If you open a BaseScan link, your browser connects directly to BaseScan, which may receive your IP address and standard browser data.

Records do not represent legally binding proof of ownership, value, authenticity, origin, or regulatory compliance. Features may change as the Service develops.

3. Accounts & Access

The Service may allow access with or without a user account. Where accounts are not used, access control is limited. If you share a Record link, anyone with the link may be able to view the provenance view.

4. Your Uploads & Content

You are responsible for the Content you upload or submit (including images, PDFs, descriptions, and attributes). You confirm that you own the Content or have permission to use it and to grant us the rights described below.

You retain ownership of your Content. However, you grant us a limited, non-exclusive, worldwide license to host, process, and display your Content solely to operate and improve the Service (for example: to generate a draft, store a Record, and display a shareable provenance view).

Please do not upload sensitive personal data, confidential materials, or anything you would not want stored or potentially shared via a link.

5. No Certification Authority

Redtail is not a certification body, auditor, notified body, or public authority. The platform does not issue official product compliance records (including CE-related conformity records or similar), and it is not a provider of qualified trust services under eIDAS. You agree not to present Records as official certificates or as independent proof of regulatory compliance or authenticity.

6. Billing & Payment

Creating a Record through the Service may incur a Charge. The current price is displayed before you place your order.

Price: 39.00 PLN per Record (VAT exempt under Art. 113 of the Polish VAT Act). The Operator will update pricing and VAT treatment if their tax status changes, with reasonable prior notice.

Billing currency: PLN (Polish zloty). PLN is the only binding transaction currency. Where an approximate EUR equivalent is shown, it is for informational purposes only — it is not an offer, is not binding, and should not be relied upon for payment or accounting.

Payment model: Postpaid. The Charge becomes due 30 days after Record creation for registered users, or 24 hours for guest users. The exact due date is shown at the time of Record creation and in the billing dashboard.

Billing details and invoices: Users may provide billing details for invoicing purposes. Where available, billing details may be stored in the user account and reused for future invoices. For guest users, billing details apply to the relevant transaction only and are not stored as a reusable billing profile for future use.

Automatic invoices: If billing details are provided, invoices may be issued automatically for future payments. Automatic invoicing does not guarantee retroactive invoice issuance for payments made before billing details were provided or before automatic invoicing was enabled.

Payment method: Payments are processed through Stripe. We do not receive or store your card details.

Overdue charges: If a Charge is not paid by its due date, we may suspend your account. While suspended, you cannot create new Records. Your existing Records remain accessible. Once all overdue Charges are paid, your account is reactivated. We do not currently charge late payment interest.

Confirmation: After placing an order, you will receive a confirmation summarising the service, price, payment terms, and your withdrawal status. This confirmation is provided on a durable medium (email) in accordance with applicable consumer protection law.

7. Right of Withdrawal

This section applies to Consumers only. If you are a Business User, this section does not apply to you.

If you enter into a paid contract with us at a distance (i.e. online), you have the right to withdraw from that contract within 14 days without giving any reason.

When you lose the right of withdrawal

During the order process, you are asked to give your express consent for the Service to begin immediately. By giving this consent and completing the order, you acknowledge and agree that you will lose your right of withdrawal once the Service has been fully performed.

When the Service is considered fully performed

The Service is considered fully performed once:

(a) the digital provenance record has been created and made available to you (including access to the record page / preview), and

(b) the on-chain transaction reference has been submitted, where applicable and technically available.

Because Record creation and on-chain submission typically happen immediately or within moments of placing the order, the right of withdrawal is typically lost at the moment of Record creation.

How to exercise withdrawal (before full performance)

If the Service has not yet been fully performed, you may withdraw by sending a clear statement to contact@redtail.id. You may use the following template:

The withdrawal period expires 14 days after the day the contract was concluded. To meet the deadline, it is sufficient to send your withdrawal statement before the period expires.

Legal basis

The right of withdrawal is provided under the EU Consumer Rights Directive (2011/83/EU) and its Polish implementation (Act of 30 May 2014 on Consumer Rights, in particular Art. 27–38). The exception for services fully performed with the consumer's prior express consent is set out in the Directive and the Act. The exact legal qualification of the Service (as a service, digital service, or supply of digital content) and the corresponding exception provision are determined by applicable law.

8. Refunds & Complaints

Refunds

Due to the nature of the Service, refunds are generally not provided once the Service has been fully performed, meaning once the Record has been created and made available to you as described in Section 7.

This does not affect your statutory rights. In particular, nothing in these Terms limits any rights you may have under applicable consumer protection law in the event of non-conformity of the Service, improper performance, or other mandatory legal grounds.

Refunds may be granted in justified cases, including:

  • technical errors preventing proper Record creation or access,
  • duplicate charges or incorrect billing,
  • payments collected in error, or
  • other exceptional situations reviewed on a case-by-case basis.

A refund may be issued in full or in part, depending on the circumstances of the case and the extent to which the Service was performed correctly.

Complaints

If you are dissatisfied with the Service or believe it does not conform to the contract, you may submit a complaint by email to contact@redtail.id.

Please include: a description of the issue, relevant Record link or order details, and your preferred resolution. We will acknowledge your complaint and respond within 14 days for Consumers (or 30 days for Business Users). If we need additional time, we will let you know within the initial period.

Submitting a complaint does not limit your right to pursue other remedies available under applicable law.

9. Service Availability

The Service is under active development. We strive to keep it available and functional, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where feasible.

This does not affect your statutory rights as a Consumer. In particular, if the Service does not conform to the contract, you retain your rights under applicable consumer protection law (including the EU Directive on digital content and digital services, 2019/770, and its Polish implementation).

10. Limitation of Liability

To the extent permitted by applicable law, the Operator's total liability to you for any claims arising from or related to the Service is limited to the total amount you have actually paid to the Operator in the 12 months preceding the event giving rise to the claim.

The Operator is not liable for indirect, incidental, or consequential damages (such as loss of profit, loss of data, or business interruption) except where such exclusion is not permitted by law.

Nothing in these Terms excludes or limits liability for: (a) intentional misconduct or gross negligence; (b) fraud; (c) death or personal injury caused by negligence; or (d) any other liability that cannot be excluded under applicable law. Your statutory Consumer rights remain unaffected.

11. Intellectual Property

The UI design, layout, and codebase belong to the Operator. Your uploaded Content remains your property. Records can be shared via link at the User's discretion.

12. Acceptable Use

You agree not to misuse the Service, including attempts to hack, overload, scrape, reverse engineer, or upload unlawful, fraudulent, infringing, or misleading Content (including impersonation or false claims).

13. Notice & Action (Illegal Content Reports)

If you believe a Record or other content on this Service is illegal, you can submit a notice electronically to contact@redtail.id.

Please include:

  • The URL (link) of the specific Record/content you are reporting.
  • An explanation of why you believe it is illegal (and where relevant, the applicable jurisdiction).
  • Your name (or organisation) and a contact email address.
  • A statement confirming that the information in the notice is accurate and submitted in good faith.

We review notices and may remove or disable access to reported content where appropriate. We may request additional information to process a notice.

14. Content Moderation

To keep the platform safe and lawful, we may remove or disable access to Records, limit sharing, or restrict access in cases of repeated misuse. We aim to act proportionately and may provide a brief explanation when feasible.

15. Privacy

Use of the Service is also governed by our Privacy Policy.

16. Contract Duration & Termination

The contract between you and the Operator is concluded when you use the Service (for free features) or when you place a paid order. The contract is for an indefinite period.

Either party may terminate the contract at any time by giving written notice (email is sufficient). Termination does not affect Charges already incurred or Records already created. On-chain transaction references are immutable and cannot be deleted after termination.

Upon termination, we may delete your account and off-chain data (uploads, Record pages) within a reasonable period, subject to legal retention obligations.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you at least 14 days before the new Terms take effect (by email if you have an account, or by a prominent notice on the Service).

If you do not agree with the updated Terms, you may stop using the Service and terminate the contract before the new Terms take effect. Continued use after the effective date constitutes acceptance.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of Poland. Any disputes will be resolved by the courts of competent jurisdiction in Poland.

If you are a Consumer habitually resident in the EU, you additionally benefit from the mandatory consumer protection provisions of your country of residence. Nothing in these Terms deprives you of that protection.

19. Dispute Resolution

If you are a Consumer, you may seek assistance from competent consumer protection or alternative dispute resolution bodies available in your country or in Poland.

We are also open to resolving disputes through mediation or other amicable means before resorting to court proceedings.
